A school's negligence has led to the swapping of marks for two students with identical names. The students who received zero marks in the 2021 examination are now unable to participate in their Class XII board exams.

New Delhi: The issue surfaced due to the school's oversight, where the marks of two students with the same names were mistakenly interchanged. As a result, the student who received zero marks in the 2021 examination faced repercussions and was unable to take part in their Class XII board exams.
A fine of INR 30,000 is imposed on a school by the Punjab & Haryana High Court for awarding zero marks to a CBSE Class 10 student in the CBSE 10th Board Exams. The issue arose due to the school's negligence, leading to the inadvertent swapping of marks for two students with identical names.
As a result, the student who received zero marks in the 2021 examination faced consequences and was unable to participate in their CBSE Class 12 board exams.

Rectifying her CBSE 10th Result, the student subsequently petitioned the Court for the correction of her examination results and the issuance of a revised marks certificate.
Upon delivering the verdict, Justice Vikas Bahl noted that it is relevant to highlight that due to the school's error, not only has the petitioner endured hardship, but the respondent-Board has also incurred litigation expenses in this case without any fault on their part.
The case was presented in court, stating that the petitioner made multiple attempts to contact the CBSE, but was informed that the school failed to submit the revised marks on the online portal within the specified timeframe.
The petitioner's advocate also asserted that, despite numerous requests, the school persistently claimed that the application had been forwarded to the Board without taking any subsequent action.
Despite receiving a notice, the school chose not to cooperate, and the Court observed that the school's nonchalant approach was evident. Consequently, the allegations raised in the petition remained unaddressed by the school.
Upon reviewing the submissions, the Court remarked that the petitioner is reported to have successfully completed her 11th class examination. However, due to the school's mistake, she was unable to take the 12th class examination. If necessary directives are not issued in favor of the petitioner, it would jeopardize her future.
Furthermore, the Court mandated CBSE to announce a new result for the petitioner, overturning the Board's previous decision that rejected the petitioner's plea for the rectification of her marks.
