Indian students currently on OPT in the United States have received their FY2027 H-1B lottery notifications — and for the first time in the programme's history, the outcome was not random. USCIS completed the FY2027 selection process under a new wage-weighted system, effective February 27, 2026, in which candidates with job offers at the highest wage level received four times the selection probability of entry-level candidates.
For the estimated 1.43 lakh Indian nationals on OPT or STEM OPT who registered for FY2027, the results mark a structural shift in how the H-1B pathway works — and who it now favours.

The Wage-Weighted Reality: How Selection Odds Changed
Effective February 27, 2026, USCIS moved to a selection process that favours higher-paid candidates. Your probability of selection was tied directly to your OEWS Wage Level — the pay tier assigned to your role relative to the prevailing wage for your occupation and location.

Most Indian students in their first year of OPT are classified at Level I or Level II for their occupation and location. Experienced professionals and senior hires had double to quadruple the pool entries. The system is designed to favour retention of high-value talent — and entry-level candidates bear the cost of that design.
The $100,000 Fee: Why Selection Is Not a Guaranteed Visa
Even for those selected in the lottery, a significant financial barrier remains. A Presidential Proclamation signed September 21, 2025 requires certain H-1B petitions — primarily those filed by IT staffing firms, consulting agencies, and other employers subject to the Proclamation — to be accompanied by an additional $100,000 payment per petition.

If your sponsor is a consulting or staffing firm subject to the Proclamation, they may decline to file your petition — even after you have been selected — because the cost is prohibitive. A selection notice received in April is not a guaranteed visa in October. Confirm your employer's status and their intention to file before June 30, 2026.
Why Indian Interest in the US Is Declining?
The FY2027 results arrive against a backdrop of declining Indian student interest in the US. New international student enrollment at US universities dropped 17% in Fall 2025, according to IIE Open Doors data. Indian F-1 visa issuances fell 69% in peak months of 2025 compared to 2024.
The US pathway now requires three things that were not simultaneously true five years ago: a high starting salary to improve lottery odds, a direct-hire employer to avoid the $100,000 fee, and a decades-long Green Card backlog for Indian nationals. Countries offering more predictable post-study work and PR pathways — Germany, Ireland, France — are gaining ground as a result.
What to Do This Week
If you were selected:
- Confirm immediately whether your employer is subject to the Presidential Proclamation fee — and whether they intend to file
- Verify that the salary on your Form I-129 matches the wage level on your registration — a discrepancy is grounds for denial
- Your employer must file between April 1 and June 30, 2026
- Employment start date must be October 1, 2026 or later
If you were not selected:
- Your OPT or STEM OPT authorisation continues until its expiry — non-selection does not affect your current status
- If you have not yet applied for STEM OPT extension, do so before your OPT expires — it provides up to 24 additional months
- Begin planning your wage level strategy for the FY2028 registration window, which opens March 2027
- Consider whether a role change, salary negotiation, or geographic move before March 2027 could improve your wage level classification
