USCIS Online Only Rule for I-765 OPT and I-539 Filings

The US Citizenship and Immigration Services (USCIS) issued an interim final rule on August 11, 2026, that lets it require online-only filing for any immigration form. The shift hits Indian F-1 graduates filing Form I-765 for OPT and STEM OPT, and dependents filing Form I-539 to change or extend status. The Department of Homeland Security opened public comments until October 13, 2026. Paper filing stays valid for each form until USCIS names that specific form and a 60-day notice runs out.

The change formalises a decade-long push to digitise USCIS intake. It sets up a new failure mode for Indian applicants who used to rely on couriered paper packets and third-party mailroom trails. A single online-form error can now push an OPT start date back by weeks.

The rule covers 22 forms already offered for e-filing, including I-765 (work authorisation, used for OPT and STEM OPT), I-539 (extend or change nonimmigrant status), I-130, I-485 and N-400.
USCIS must post at least 60 days of public notice on its website before switching any single form to online-only.
Applicants who cannot file electronically can request an exemption using the new Form I-936, granted case by case for undue hardship.

Why F-1 students should care first: I-765 for OPT and STEM OPT and I-539 for status extensions are the two forms student life runs on, and both have long been online eligible, making them prime early candidates for online only designation. DHS published the interim final rule on August 11, 2026. It amends USCIS regulations to let the agency designate any form as electronic-filing-only. A form qualifies once it has been available online for at least 180 days.

Which Forms Are on the Online-Only Shortlist

USCIS confirmed that as of December 2025 it accepts 22 forms online. Any of these can be moved to online-only after the 60-day notice. The forms most relevant to Indian students are in the table.

The I-765 is the highest-volume form for Indian graduates. USCIS opened it for online filing in April 2021, so it has cleared the 180-day threshold by nearly five years.

How the Change Hits Indian F-1 and STEM OPT Filers

Indian nationals held 331,602 US student visas in the 2023-24 academic year, per Open Doors 2024, and are the single largest OPT cohort. Every one of them files an I-765 for post-completion OPT and again for the 24-month STEM extension. A move to online-only compresses the margin for error.

Post-completion OPT applicants have a 30-day window from I-20 issuance to file, and a hard 90-day pre-graduation ceiling. Missing that window under an online-only system means no paper fallback. Applicants without stable internet, US-issued payment cards, or scanning capacity at graduation will feel this first.

What it means for Indian Students: Payment is the quiet friction point. Online I-765 filing requires a US bank card or ACH withdrawal from a US account. Students filing from India before travel, or on the weekend after graduation, need to have that payment method live before the 30-day clock starts.

How Do You Request a Paper Filing Waiver?

DHS built an escape hatch into the rule. Applicants who cannot file online can submit the new Form I-936, Request for Exemption from Electronic Filing Requirement. USCIS decides each request individually and grants it only for undue hardship.

The rule text does not define undue hardship in detail. Categories the agency has flagged include disability, lack of internet access, and technical incompatibilities with the online portal. A denial of the I-936 does not extend the filing window for the underlying form.

When Can USCIS Flip a Form to Online Only?

The earliest any form can become online-only is 60 days after USCIS posts the specific notice. That notice will appear on the USCIS newsroom page and in the Federal Register. Public comments on the framework itself close on October 13, 2026 at 11:59 pm ET (10:29 am IST, October 14, 2026).

The American Immigration Lawyers Association and several advocacy groups have flagged the interim final rule route as unusual for a change of this scale, since it bypasses the normal notice-and-comment period before taking effect. Any legal challenge would target that procedural choice, not the underlying digitisation.

The August 11, 2026 rule reshapes how Indian graduates will file for OPT, STEM OPT and status changes within the next year. The next inflection point is the first form-specific notice from USCIS, which will trigger the 60-day countdown.
